Let’s talk 1099s! This can get a bit confusing with all of the different types of 1099s and exceptions, so we broke it down for you! 

This is a good time to review who you may need to issue a 1099 to and confirm you have a W9 form on file from those contractors. The deadline to issue a 1099 is January 31, 2023.

A 1099-NEC (non employee compensation) form is used to report money that was paid to an independent contractor, for services such as landscaping, office cleaning, or professional services such as a lawyer or accountant, etc. You will still use the 1099-MISC to report money paid to landlords, etc. 

There are some exceptions – if you paid the contractor under $600, paid them by credit card or PayPal, Venmo, cash app, etc. (this does not include debit card or Zelle), or if they are a corporation (except for attorneys), you do NOT need to issue a 1099.

Who needs a 1099 NEC?

Anyone that was paid more than $600 to an independent contractor or for services such as landscaping, office cleaning, professional services such as a lawyer or accountant, etc.

Exceptions:

If you paid them with a credit card, Venmo, PayPal, cash app, etc  – you do not need to issue. If they are taxed as a corporation or s-corp – you do not need to issue.

If they are an attorney – you need to issue even if they are a corporation/scorp or even if you paid them less than $600.

Landlords

Check out this chart below for help  –with cash, check, etc should also be debit card and Zelle (do need a 1099). Along with paypal – is Venmo, cash app, etc (do not need 1099).
